OVERVIEW

Welcome to Bloc Wines. These Terms of Service, together with any policies referenced in them, describe the terms and conditions that apply when you visit, access, interact with, purchase from, or otherwise use our website, online store, products, content, tools, communications, and related services (collectively, the “Services”).

The terms “Bloc Wines,” “we,” “us,” and “our” refer to Bloc Wines, Inc., doing business as Bloc Wines. Our Services are powered by Shopify, which helps us operate our online store and provide the Services to you.

Please read these Terms carefully. They contain important information about your legal rights and responsibilities, including alcohol-specific purchase requirements, shipping restrictions, warranty disclaimers, limitations of liability, promotional offer rules, and terms governing subscriptions and recurring orders.

By visiting, accessing, using, creating an account, placing an order through, or otherwise interacting with the Services, you agree to be bound by these Terms and our Privacy Policy, available at Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access the Services.

Because we sell alcoholic beverages, the Services are intended only for individuals who are at least 21 years of age. You may not use the Services, create an account, place an order, purchase wine from us, or receive wine from us if you are under 21 years of age.

 


 

SECTION 1 — ELIGIBILITY, AGE VERIFICATION, AND ACCOUNT ACCESS

You represent and warrant that you are at least 21 years of age and that any information you provide to us, including your name, date of birth, billing information, shipping information, email address, phone number, and payment information, is accurate, current, complete, and belongs to you or is provided with proper authorization.

We may use third-party age verification, identity verification, address validation, fraud prevention, compliance, payment processing, fulfillment, carrier, and subscription tools to verify your eligibility to purchase and receive wine and to process your orders.

We reserve the right to request additional information, refuse service, cancel an order, hold shipment, suspend an account, restrict access to the Services, or take other reasonable action if we believe, in our discretion, that:

  1. you are under 21 years of age;

  2. the intended recipient is under 21 years of age;

  3. your order or shipment would violate applicable law;

  4. your information is inaccurate, incomplete, fraudulent, unverifiable, or inconsistent;

  5. your order appears to be for resale, export, unauthorized distribution, or other commercial use;

  6. we are unable to legally ship to the requested destination;

  7. payment authorization, age verification, address validation, compliance screening, or fraud screening cannot be completed; or

  8. you have violated these Terms or any applicable policy.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.

 


 

SECTION 2 — ALCOHOL PURCHASE REQUIREMENTS

All wine purchased through the Services is sold only to persons who are at least 21 years of age and only for personal use, not for resale, export, unauthorized distribution, or other commercial use.

By placing an order, you represent and warrant that:

  1. you are at least 21 years of age;

  2. the recipient of any wine shipment is at least 21 years of age;

  3. the person accepting delivery will present valid government-issued photo identification and provide an adult signature if required by the carrier;

  4. your purchase is for personal or household use and not for resale, distribution, export, or any other commercial purpose;

  5. you are purchasing and receiving wine only in a jurisdiction where the purchase and shipment are legally permitted; and

  6. you will comply with all applicable laws regarding the purchase, possession, receipt, transportation, storage, and use of alcoholic beverages.

Wine packages cannot be delivered to minors. Wine shipments generally cannot be left unattended, left at a door, delivered without an adult signature, or delivered to a person who cannot provide valid proof of age. If no adult 21 years of age or older is available to sign for the shipment, delivery may be delayed, reattempted, held for pickup, returned to us, or otherwise handled by the carrier according to carrier rules and applicable law.

Alcohol should be consumed responsibly. Do not drink and drive. Do not consume alcoholic beverages if you are pregnant, may become pregnant, have a medical condition that makes alcohol use unsafe, are taking medication that may interact with alcohol, or have been advised not to consume alcohol.

 


 

SECTION 3 — WHERE WE SHIP

Bloc Wines ships only to U.S. states and jurisdictions where we are licensed, permitted, registered, or otherwise authorized to ship wine directly to consumers. The states and jurisdictions we serve may change over time based on licensing, compliance, carrier availability, operational decisions, legal changes, and other factors.

The availability of shipping to a particular state, county, zip code, address type, or customer may be determined at checkout or during order processing. We may refuse, hold, modify, or cancel any order if we determine that shipment is not permitted, cannot be completed through an approved carrier, or would create legal, compliance, operational, or carrier risk.

You should not rely on any general statement on the website as a guarantee that we can ship to your location. If the checkout process allows you to submit an order, that does not guarantee final acceptance, legal clearance, or shipment. All orders remain subject to payment authorization, age verification, fraud screening, compliance review, and carrier availability.

We do not ship to P.O. boxes, APO/FPO/DPO addresses, freight forwarders, mail drops, or any other address type where adult signature delivery is unavailable or where shipment is otherwise prohibited or impractical. Additional address restrictions may apply.

SECTION 4 — TITLE PASSAGE AND SHIPMENT AUTHORIZATION

All wine is sold by Bloc Wines, Inc. from California. By placing an order, you authorize Bloc Wines to arrange shipment of the wine on your behalf to the delivery address you provide, using a licensed or otherwise authorized common carrier that supports alcohol delivery and adult signature requirements.

To the fullest extent permitted by applicable law, title to and ownership of wine purchased from Bloc Wines pass from Bloc Wines to you in California when the wine is purchased and tendered to the carrier for shipment. By placing an order, you are responsible for complying with all laws applicable to your purchase, possession, transportation, receipt, and use of the wine.

Nothing in these Terms is intended to override any non-waivable consumer protection right, alcohol direct-shipping requirement, carrier requirement, or other applicable law. If any portion of this title passage provision is not permitted in a particular jurisdiction, that portion will apply only to the maximum extent permitted by law, and the remaining provisions of these Terms will remain in effect.

 


 

SECTION 5 — OUR PRODUCTS

We make reasonable efforts to describe and display our wines accurately, including product names, vintages, appellations, varietals, tasting notes, packaging, images, formats, and other product information. However, product descriptions, images, colors, packaging appearance, vintages, availability, allocations, and other details may change without notice.

Product images and colors may appear differently depending on your device, screen settings, lighting, and browser. We do not warrant that the appearance or quality of any product will exactly match any image or description shown through the Services.

Unless expressly stated otherwise, tasting notes, pairing suggestions, serving suggestions, and similar content are general descriptions only. Wine is an agricultural product and may vary by vintage, lot, storage condition, handling, temperature, and individual taste preference.

We reserve the right to discontinue any product, change product information, limit quantities, restrict allocations, refuse orders, or limit sales to any person, household, account, geographic region, or jurisdiction at any time, subject to applicable law.

 


 

SECTION 6 — ORDERS, ACCEPTANCE, AND PRE-ORDERS

When you place an order, you are making an offer to purchase the products in your cart. We reserve the right to accept, decline, hold, modify, or cancel your order for any reason, including product availability, compliance review, payment authorization, age verification, address validation, weather conditions, carrier limitations, suspected fraud, pricing errors, or legal restrictions.

Your order is not accepted until we confirm acceptance and process your payment. A checkout confirmation, payment authorization, or automated order acknowledgment does not guarantee that your order has been finally accepted or that shipment will occur.

Please review your order carefully before submitting it. Once an order is accepted, packed, submitted to fulfillment, or transferred to a carrier, we may be unable to cancel or modify it.

From time to time, we may offer products for pre-order or advance purchase. Estimated production, release, fulfillment, or shipment dates are estimates only and are not guaranteed. If a pre-order cannot be fulfilled, is delayed, or becomes legally or operationally unavailable, we may contact you, substitute only with your consent where required, cancel the order, or issue a refund according to applicable law and our policies.

 


 

SECTION 7 — PRICES, TAXES, FEES, AND BILLING

Prices, discounts, promotions, shipping charges, taxes, deposits, recycling fees, handling fees, and other charges are subject to change without notice. The price charged for a product will generally be the price in effect at the time the order is placed, as shown in your order confirmation, unless the price is incorrect due to an error or omission.

Unless expressly stated otherwise, listed prices do not include applicable taxes, shipping, handling, carrier fees, adult signature fees, recycling fees, bottle or container deposits, regulatory fees, or similar charges. We may collect, remit, include, or otherwise account for taxes, deposits, recycling fees, and similar charges as required or permitted by applicable law. These amounts may vary by jurisdiction and may change over time.

You agree to provide current, complete, and accurate purchase, payment, billing, shipping, and account information for all purchases. You represent and warrant that:

  1. the payment information you provide is true, correct, and complete;

  2. you are authorized to use the payment method provided;

  3. charges incurred by you will be honored by your payment provider; and

  4. you will pay all charges incurred by you at the prices shown at checkout, including applicable shipping, taxes, deposits, fees, and other charges.

If a payment is declined, reversed, disputed, or otherwise not completed, we may cancel or suspend your order, delay shipment, terminate any subscription or account feature, or seek payment for amounts owed.

 


 

SECTION 8 — DISCOUNTS, PROMOTIONS, REFERRALS, AND OFFERS

We may offer discounts, promotional codes, referral offers, introductory offers, bundles, gifts with purchase, subscription incentives, shipping promotions, loyalty offers, event offers, influencer offers, customer win-back offers, or other promotions from time to time (collectively, “Promotional Offers”). Promotional Offers may vary by customer, customer group, channel, location, marketing campaign, referral source, purchase history, order type, product availability, shipping destination, or other criteria determined by us.

Unless a Promotional Offer expressly states otherwise, the following default rules apply:

  1. Promotional Offers are available for a limited time only and may be modified, suspended, or discontinued at any time without notice.

  2. Promotional Offers are not guaranteed to be available to all customers or in all states or shipping destinations.

  3. Promotional Offers may be limited to new customers, existing customers, first-time purchasers, returning purchasers, subscribers, non-subscribers, referral recipients, event attendees, email or SMS subscribers, or other eligible groups.

  4. Promotional Offers may be limited to specific products, bundles, order quantities, order values, purchase frequencies, shipment dates, shipping methods, or delivery destinations.

  5. Promotional Offers are limited to one per customer, household, account, email address, phone number, billing address, shipping address, and/or payment method, unless we expressly state otherwise.

  6. Promotional Offers may not be combined, stacked, transferred, sold, assigned, redeemed for cash, applied retroactively, or used with any other discount, promotion, referral credit, store credit, gift card, subscription discount, free-shipping offer, or other offer unless we expressly state otherwise.

  7. Promotional Offers may not apply to taxes, deposits, recycling fees, shipping, handling, adult signature fees, return fees, reshipment fees, or other regulatory or carrier charges unless expressly stated.

  8. Promotional Offers are subject to product availability, legal shipping eligibility, age verification, fraud screening, compliance review, and all applicable alcohol laws.

  9. We may refuse, cancel, reverse, or adjust any Promotional Offer, order, discount, credit, or benefit that we believe, in our discretion, is the result of error, fraud, misuse, abuse, duplicate account creation, automated activity, resale activity, unauthorized transfer, circumvention of offer rules, or violation of these Terms.

  10. Promotional Offers have no cash value and do not create any vested right, entitlement, or continuing obligation by Bloc Wines.

Specific Promotional Offers may have additional or different terms presented in advertising, emails, text messages, landing pages, social media posts, event materials, referral materials, checkout pages, product pages, subscription pages, or other offer communications. These Terms govern all Promotional Offers unless the specific Promotional Offer expressly contradicts these Terms. If there is a conflict between these Terms and the specific terms of a Promotional Offer, the specific Promotional Offer terms will govern only for that Promotional Offer and only to the extent of the conflict. All other provisions of these Terms will continue to apply.

 


 

SECTION 9 — SUBSCRIPTIONS, CLUBS, AND RECURRING ORDERS

We may offer subscriptions, club memberships, recurring shipments, replenishment programs, or other automatic renewal or continuous service programs (collectively, “Subscriptions”). Subscriptions may be managed through Awtomic and/or other third-party service providers.

The specific terms of each Subscription, including products, shipment frequency, billing frequency, pricing, discounts, renewal terms, cancellation policy, skip or pause options, and any minimum commitment, will be disclosed at checkout, in the offer terms, in your customer account, or in other Subscription-related communications.

By enrolling in a Subscription, you authorize Bloc Wines and our payment processors to charge your selected payment method on a recurring basis for the applicable products, shipping, taxes, deposits, recycling fees, and other charges until you cancel, pause, skip, or otherwise modify the Subscription in accordance with the applicable Subscription terms.

Subscription prices, product availability, shipping charges, taxes, deposits, recycling fees, and other charges may change over time. We will provide notices of material changes, renewal reminders, promotional-period expiration notices, cancellation instructions, and other disclosures as required by applicable law.

You may cancel, skip, pause, or manage a Subscription through the available customer account tools, through the cancellation method provided in your order confirmation or account, or by contacting us at hello@drinkbloc.com. If your Subscription was activated online, we will provide an online cancellation method where required by law. We will not intentionally obstruct or delay a valid cancellation request.

Cancellation requests must be received before an order is processed, packed, submitted to fulfillment, or transferred to the carrier. If a recurring order has already been processed, we may be unable to cancel that shipment, but cancellation will apply to future eligible shipments.

We may terminate, suspend, modify, or refuse renewal of a Subscription if we are unable to process payment, verify age, legally ship to your address, fulfill the applicable products, or otherwise comply with applicable law.

 


 

SECTION 10 — SHIPPING, DELIVERY, WEATHER HOLDS, AND CARRIER ISSUES

Shipping and delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, high or low temperatures, fires, natural disasters, labor disruptions, address errors, recipient unavailability, failed age verification, compliance holds, fulfillment delays, or events outside our reasonable control.

Because wine is temperature sensitive, we may delay, hold, reroute, or modify shipment timing when we believe weather conditions may create risk to product quality or delivery. Weather holds are not guaranteed and do not eliminate all risk of temperature exposure during transit.

All wine shipments must be delivered by approved carriers that support alcohol delivery and adult signature requirements. You are responsible for ensuring that an adult 21 years of age or older is available to receive the shipment at the delivery address. Business addresses may be preferable where permitted because adult signature delivery is required.

If a package is returned due to an incorrect address, failed delivery attempts, recipient unavailability, refusal, failure to provide valid identification, or other issue not caused by us, we may charge or deduct applicable shipping, return, reshipment, restocking, or carrier fees to the extent permitted by law.

SECTION 11 — RETURNS, REFUNDS, DAMAGED PRODUCTS, AND CUSTOMER CARE

Wine is a regulated, perishable, and temperature-sensitive product. Returns, exchanges, refunds, credits, replacements, and cancellations are handled according to our Returns & Refunds Policy and applicable law.

If your shipment arrives damaged, leaking, missing items, materially incorrect, or otherwise affected by a fulfillment issue, please contact us promptly at hello@drinkbloc.com with your order number, a description of the issue, and photos where applicable. We may require documentation to process a carrier claim, refund, credit, or replacement.

We reserve the right to decline refund, replacement, or credit requests where we reasonably determine that damage or loss resulted from recipient unavailability, failed delivery attempts, address errors, improper storage after delivery, unauthorized resale, misuse, or other circumstances outside our control.

 


 

SECTION 12 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, available at Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy and the policies of other third-party providers that help us operate the Services.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services may be transmitted to and shared with Shopify and other third parties, including payment processors, age verification providers, fraud prevention providers, compliance providers, subscription providers, fulfillment providers, carriers, marketing providers, analytics providers, and other service providers, which may be located outside your state or country of residence.

SECTION 13 — MARKETING COMMUNICATIONS, EMAIL, AND SMS

You may receive transactional communications from us relating to your account, orders, shipments, Subscriptions, customer service requests, legal notices, and other service-related matters. These transactional communications are not promotional and may be sent even if you opt out of marketing communications.

If you sign up to receive marketing emails or text messages, you consent to receive promotional communications from us, subject to the consent, opt-out, and message terms presented at signup. You may unsubscribe from marketing emails by using the unsubscribe link in the email. You may opt out of marketing text messages by following the instructions provided in the message, such as replying STOP, where applicable.

Marketing communications may include product announcements, launch updates, promotions, discounts, back-in-stock notices, abandoned cart reminders, subscription offers, event invitations, and other Bloc Wines content.

 


 

SECTION 14 — INTELLECTUAL PROPERTY

The Services, including all trademarks, brands, logos, trade names, product names, designs, slogans, text, product descriptions, images, graphics, packaging designs, videos, audio, user interfaces, website design, selection, arrangement, and other content, are owned by Bloc Wines, its affiliates, licensors, or service providers and are protected by U.S. and foreign intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, scrape, extract, train artificial intelligence models on, or transmit any material from the Services without our prior written consent, except as permitted by applicable law.

Bloc Wines’ names, logos, product names, packaging designs, and slogans are trademarks or trade dress of Bloc Wines or its affiliates or licensors. You may not use them without our prior written permission. Shopify’s name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

 


 

SECTION 15 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, features, applications, integrations, checkout tools, payment options, subscription tools, age verification tools, compliance tools, address validation tools, fulfillment tools, carrier tools, analytics tools, marketing tools, or other functionality provided by third parties. We do not control all third-party tools and are not responsible for their availability, performance, accuracy, security, or terms.

Your use of third-party tools is at your own risk and may be subject to the terms and privacy policies of the applicable third-party providers. We provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement, except as expressly stated by us.

We may add, remove, modify, suspend, or replace features, tools, providers, and integrations at any time. Any new features or tools made available through the Services will also be subject to these Terms unless separate terms apply.

 


 

SECTION 16 — THIRD-PARTY LINKS

The Services may contain links to websites, materials, content, social media pages, applications, or other resources provided or operated by third parties. We are not responsible for examining or evaluating the content, accuracy, policies, practices, or availability of third-party materials or websites.

If you choose to access third-party websites or resources, you do so at your own risk. We are not liable for any harm or damages related to your access to third-party websites or your purchase or use of any products, services, resources, or content from third parties. Please review third-party policies and practices carefully before engaging in any transaction.

 


 

SECTION 17 — RELATIONSHIP WITH SHOPIFY

Bloc Wines is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Bloc Wines. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bloc Wines, including any injury, damage, loss, or claim resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bloc Wines.

 


 

SECTION 18 — REVIEWS, TESTIMONIALS, AND FEEDBACK

If you submit, upload, post, email, tag, message, or otherwise provide any reviews, testimonials, photos, videos, comments, ideas, suggestions, feedback, proposals, plans, social media content, or other materials relating to Bloc Wines or the Services (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, transferable, royalty-free license to use, reproduce, modify, publish, distribute, display, create derivative works from, and otherwise use such Feedback in any medium for any lawful purpose, including commercial, marketing, product development, and promotional purposes.

You represent and warrant that:

  1. you own or have all necessary rights to provide the Feedback and grant the rights described above;

  2. your Feedback is truthful, accurate, and reflects your honest opinions and experiences;

  3. your Feedback does not violate any third-party rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights;

  4. your Feedback does not contain unlawful, defamatory, abusive, obscene, threatening, harassing, misleading, or otherwise objectionable content;

  5. your Feedback does not contain viruses, malware, or harmful code; and

  6. you have clearly disclosed any compensation, free product, discount, incentive, employment, family, business, or other material connection you have with Bloc Wines in connection with the Feedback.

We may, but have no obligation to, monitor, edit, refuse, remove, or use Feedback. We are not obligated to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback.

 


 

SECTION 19 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on or through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, discounts, product availability, shipping charges, taxes, deposits, recycling fees, transit times, vintages, appellations, tasting notes, or other information.

We reserve the right to correct errors, inaccuracies, or omissions, change or update information, refuse orders, or cancel orders if any information is inaccurate at any time, including after you have submitted an order or received an order confirmation. If we cancel an order after payment has been processed, we will issue an appropriate refund for the canceled portion of the order.

 


 

SECTION 20 — PROHIBITED USES

You may access and use the Services only for lawful purposes and in accordance with these Terms. You may not access or use the Services, directly or indirectly:

  1. for any unlawful, fraudulent, abusive, harmful, or malicious purpose;

  2. to purchase, attempt to purchase, receive, or attempt to receive alcohol if you or the recipient are under 21 years of age;

  3. to ship or attempt to ship wine to a jurisdiction, address, person, or entity where shipment is prohibited;

  4. to purchase products for resale, export, unauthorized distribution, or other commercial purposes;

  5. to violate any federal, state, provincial, territorial, local, or international law, rule, regulation, or ordinance;

  6. to infringe or violate our intellectual property rights or the rights of others;

  7. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, threaten, or discriminate against any person;

  8. to submit false, misleading, inaccurate, fraudulent, or incomplete information;

  9. to impersonate any person or entity;

  10. to interfere with or circumvent age verification, address validation, fraud prevention, compliance, security, or authorization measures;

  11. to upload or transmit viruses, malware, or harmful code;

  12. to spam, phish, pharm, pretext, scrape, crawl, or harvest information;

  13. to use automated tools, bots, spiders, scrapers, data extraction tools, AI agents, or other automated means to access, copy, monitor, train on, or interact with the Services without our prior written permission;

  14. to manipulate, abuse, or circumvent promotions, discounts, referral programs, account limits, quantity limits, or shipping restrictions;

  15. to interfere with any other person’s use or enjoyment of the Services; or

  16. to engage in conduct that, in our judgment, harms Bloc Wines, Shopify, our service providers, our customers, or the Services, or exposes any of them to liability.

We reserve the right to suspend, disable, restrict, or terminate your account or access to the Services at any time if we determine that you have violated these Terms or applicable law.

 


 

SECTION 21 — AGENTS AND AUTOMATED ACCESS

This section applies if you use, allow, enable, or cause the deployment of any software, service, bot, crawler, scraper, AI agent, browser automation, or other technology that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity to access, use, or interact with the Services (an “Agent”).

No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with these Terms and all technical requirements we provide. We may limit, block, or otherwise control whether and how Agents access, use, or interact with the Services.

Agents must not conceal or obfuscate that access, use, or interaction is from an Agent; mimic human behavior to avoid detection; complete or circumvent CAPTCHAs or similar measures; ignore robots.txt, robot exclusion headers, rate limits, access restrictions, or other technical controls; or continue accessing the Services after we have requested that the Agent stop.

 


 

SECTION 22 — TERMINATION

We may terminate these Terms or your access to all or part of the Services at any time, with or without notice, if we determine that you have violated these Terms, violated applicable law, created legal or operational risk, failed payment, provided inaccurate information, attempted to purchase or receive alcohol unlawfully, or otherwise engaged in conduct we determine to be harmful or inappropriate.

You will remain liable for all amounts due up to and including the date of termination.
